Attesar respects intellectual property and expects sellers to do the same. This policy explains how rights-holders can report infringement, how we handle notices, and how sellers can respond. It is designed to comply with the Information Technology Act 2000 and the Intermediary Guidelines 2021 in India, the Digital Millennium Copyright Act in the United States, the EU Copyright Directive and equivalent laws.
01How to Report Infringement#
Use the notice form on this page or email legal@attesar.com with:
Incomplete notices may be rejected. Knowingly false notices may expose you to liability.
- your name, company (if any), email and, optionally, phone;
- the URL of the listing, profile or post you are reporting;
- a description of the work you own (with a link or registration number where possible);
- the basis of your claim (copyright, trademark or other right) and why the listing infringes it;
- a statement that you believe in good faith the use is not authorised by the rights-holder, their agent or the law;
- a statement, under penalty of perjury where applicable, that the information is accurate and that you are the rights-holder or authorised to act for them; and
- your physical or electronic signature.
02What We Do With a Notice#
We acknowledge notices promptly and review them within 72 hours. If the notice is valid, we remove or disable the listing, notify the seller with a copy of the notice (minus your contact details unless you agree to share them), record a strike against the seller, and inform you of the outcome. Where the listing has already sold, we may hold the seller's funds pending resolution.
03Counter-Notice#
A seller who believes a removal was mistaken or that they have the rights may file a counter-notice with: identification of the removed listing; a statement under penalty of perjury that they have a good-faith belief the material was removed by mistake or misidentification; their name, address and contact details; and consent to the jurisdiction of the courts at our registered office (and, for US notices, the relevant US federal court). We forward the counter-notice to the reporter. If the reporter does not notify us within 10 business days that they have filed a court action, we may restore the listing.
04Repeat Infringers#
Sellers who receive three valid notices, or one notice for wilful infringement, are permanently removed and their pending balances are held until any claims are resolved.
05Trademarks#
Brand names, logos and character likenesses may not be used in product content or listing titles without a licence, except for accurate descriptive references (for example "compatible with Figma").
06Buyers#
If you bought a product that is later removed for infringement, open a dispute; refunds are handled under the Refund Policy.
